I rear ended someone who slammed there brakes on.
I ALWAYS MAKE MY PAYMENTS. This one time its possible we forgot due to health issues. So, we are 7 days from the cancellatrion date ot the 30th. WE did not get the notice my mail due to a very unreliable postal service in this small town. Any Advice.

THey claim that I have no insurance as of 4/30. My accident was on 5/7. Due date of bill is 4/6. ANy advice as to fight there claim that the policy is closed? Even though I never missed a payment they claim I did. And to my knowledge
I have not recieved any mailed cancellation notice. We had a payment due notice by email but not a cancellation notice .

Hope that the other person is judged to be at fault.

The insurance company just has to prove that they mailed it; normally a cancel bill is sent certified mail, but a renewal bill might simply cancel if not paid without a certified letter.

What you'd like to happen is have the policy reinstate without a lapse, but insurance companies usually only do this with a signed no-loss letter (where you say nothing claims-related happened since the cancel date). In my experience, "unreliable postman" has not been a successful argument.

The system is designed to not allow people to get insurance after an accident. Sorry. Just telling you how it is.

The insurance company will be happy to provide proof of mailing of your notice of cancellation. If the policy was cancelled, you were driving uninsured, pure and simple.

You knew when the payment was due and didn't make it. A prudent person would assume that the policy was therefore lapsed and would not drive until they verified the status of the policy.

Sorry, but there's nothing for you to fight. You were driving uninsured, following too close and caused an accident, and will now have to cover the resulting damages out of your own pocket. It's likely that your license will be pulled until the damages are paid in full.

Your insurer does NOT have to provide you with a cancellation notice due to non-payment. They also have every right NOT to reinstate your policy (since you've had an accident) but there is an outside chance you can make the payment and the company will reinstate. Forget any legal action -- this mess is all on you, no matter what the circumstances.

As a broker, I heard this before. Nobody ever gets there cancellation notices it seems, but they get everything else. Bottom line, you are the one that knows when the payments are due for home, car, credit card, water, electricity, and insurance. Different policies in different jurisdictions have different cancellation procedures, but each company does have it spelled out. You missed your payment, maybe not on purpose, but, you still missed it, and, unfortunately your policy was properly cancelled. The only way to re-instate your policy as of the cancellation date would be to prove you actually paid it,

There is a provision in the policy called "grace period." It spells out how late you may be with the payment, and what happens if you don't make it.

I'll bet you got your ins of the Internet. Why do I say that? Because if you would have had an agent, he would have been notified by the co that you were overdue, and the agent would have called you. That's what a good agent does.

I agree with the other people but, if you have an agent they maybe able to do you a favor and back date a payment. when I worked for Farmers Insurance we had agents that did this it did get them in trouble and you also but ,if you don,t ask you won't know . Don't hold your breath in my state the accident would be your fault and a citation for no proof of insurance and even cost you the impounding of your vehicle.
