I was involved in a car accident which we are trying to settle outside of involving our insurance brokers, but now the person who I hit is acting funny which makes me nervous.

You should file a claim with your insurance company in a timely manner. Go ahead and file a claim with your insurance company - if you are not a fault - it will not affect any good driver/claim discounts. This way you are protecting yourself and your claim won't be denied later based on late notice.

You can always tell your insurance company you are trying to work it out with the other party, but go ahead and file that claim.

This always happens when it is kept quiet. one person starts to get funny. I hate to bare bad news although you have every right to feel nervous. You should report it just incase someone may start to feel pain from the accident.
without your insurance company you could be sued for damages so report it and if nothing happens then at least you are safe from litigation and we all knows what a bad world can be when Liars, I mean lawyers get involved.
If your collision might exceed 1000 dollars then you should report it immediately.

Technically, you are required to file an SR-1 report of accident to CA DMV within 7-10 days.

the state requires you to report all accidents to them if the damages exceed $500 or you have bodily injury. we had people who waiting to report to us and it was ok .
