my niece recently got pregnant. Her status here as a student has finished 8 months ago, and she is in her OPT (optional practical training) it's a requirement for all international student to have once they graduated, so they can work in the States. She still searching for a job. She is not an illegal alien because she came here going through all the rules and obey the US law as an international student. She has only 4 months left to get a job and not be illegal because if she hasnt got a job after that, she will be an illegal if she stayed here. She would want to stay here and get a job and all that, hopefully be able to apply for a green card one day after she gets a job. Unfortunately, she is pregnant now, a month pregnant. She is worrying that her status would be in a big trouble because she is giving a birth here and not in her country. Will the baby called "anchor baby" like those illegal aliens babies? I hope not. what do u guys think? what does she have to do?

If she really wants to do the right thing, have her go home to her country, let them pay for her baby. What you are asking for is two things. A way to get around the system, so that she can stay and get a green card using the baby. And you want to feel superior to the other illegals aliens that are also using our system for their own means. Once again, she needs to go home and not stick the bill for her baby on the tax payer

She needs to find a job.... it's just that simple. And then get a green card. When she had everything going for her, she didn't have the good common sense to use protection during sex ??? So, now , if she does not find a job, she needs to go to her home country to have that baby. Even if she has the baby here, she can still be deported because she will be treated as an illegal.

she should keep looking for a job and since she is still here legally she should apply for an extension on her visa. after she applies she should receive a paper saying that she is waiting on approval that way she is technically still here legally after her other visa expires. as for the baby, if the father is a US citizen then the baby is a citizen automatically, if the father isn't then she would need to get her new visa and if the baby is born here in the US then the baby is a citizen. but since she came here following all the rules as long as she keeps following them she and her baby will be fine.

A US citizen is only an 'anchor baby' if the parents are capitalizing on said citizenship in a bid to remain in the country in spite of its laws.

If your niece wants her baby to be a citizen of her homeland, she shouldn't have it in the US, since the US insists that anyone born within its borders is a citizen, and doesn't recognize dual citizenship.

If she's done all the right things, then any one who calls her baby an anchor baby deserves a kick in the balls.
