The USMC does have a trademark for their uniform, but since it does seem to be the best uniform option, the Army went with it's own variation of it. I really doubt that the USMC would even consider suing the Army though, at most, it would call for the Army to adopt a different uniform.

The Marine Corps uniform is trademarked.So will the new Air Force camouflage uniform.
The old woodland camouflage and 3-color desert uniform was for use throughout all the services.
The ACU uniform is not trademarked.

As a person about to be in the marines and having many friends that are active duty. I think people would be way to afraid to try to steal the marines stuff.

D.O.D. runs all the branches of armed services and the uniforms are mission specific
if anyone wanted to sue it would be canada they where the first armed force to adopt digi-camo pattern before anyone else

All the services are under the direction of the department of defense, so the USMC can't sue the US army. the USMC has its own set of Cammie's and no other branch of the service would use them.

The ACU is not trademarked....and nobody would try to use the Marine Corps digital cammies because they already know that they are strictly for the Corps....

If the Department of Defense decides to dress everyone up like Ronald McDonald then that's what they will wear.
The Marines are a part of the Navy, which is part of DoD.
