Here's my situation, my sister had a baby in Febuary, he is going to be 3 months. She hardly is ever with the baby. They both live with me. She is in and out all day everyday, she does not pay attention to him when she is home. The father of her baby is not in his right of mind right now, he is recovering from a liver transplant. My husband and I want to adopt him, since his parents are not really around, how can we go about doing this?

If you are going behind her back to do it, you would have to prove she is an unfit mother. Then she would get a chance to prove that she is a good mother. While doing this, she could get her child and disappear.

If you ask her if you can have him, and get her to sign him over, you might or might not cause her to disappear. Basically, you need to shut down on your sister's right to come and leave as she pleases. If she can't or won't stop doing it, tell her that you want the child legally since you are the one taking responsibility for him. That you want to go the legal route she in case she is incognito, you would have the authority to have him treated in case something happens to him.

this could get nasty you know.if you try to take her child away legally, she just may take him away from you physically. i don't know her age but she sounds very young. you could try having her take some parenting classes.she obviously has no idea what parenthood is about and odds are, as long as you will care for the baby, she won't but, that doesn't mean she'll let you adopt him w/o a fight. it's very difficult to do something like this. very. you'll have to prove her an unfit mother and what she's doing now won't be enough. the courts will first try to teach her how to be a parent. except for extreme measure's they usually like to keep the child with it's bio parent's. also. what about the baby's dad? you'll have to get his permission as well.
