Yes, just like clams. Also like clams, if they don't open or they are broken DON'T eat them.

They don't have to be. i have bought frozen mussels, so I would bet they are not alive. Same rule holds when cooked, if they don't open don't eat them.

They probably are, like other shelf fish. Otherwise you compromise freshness and healthiness for consumption.
