Doesn't he have to be with you for a full 6 months? But if he's going to be getting government assistance..what are you worried about claiming him so fast for? Poor guy!

To claim your brother-in-law as a dependent, he must meet five criteria..

1. Gross Income – The dependent earns less than $3,300 in income during the year,
2. Total Support – You provide more than half of the dependent's total support during the year,
3. Relationship – You are related to the dependent in certain ways,
4. Joint Return – If the dependent is married, the dependent cannot file a joint return with his or her spouse.
5. Citizenship - The dependent must be a citizen or resident alien of the U.S.

As soon as he is earning less than the allowable amount on the test for dependents in your 1040 IRS book.You can claim him, but he cannot claim himself if you do. He will have to file a return if he has any earned income or even $1.00 in interest earned in a year. But a gov. assist check will not usually be taxable as earned income unless he has some other type of income.
There are some variables I don't know such as age or timetable, but you should have no problem in the claiming him as long as he passes the income test.

You may need to check if his company does or does not give him an insurance coverage. The coverage would also come in handy during this time for his treatment. If he is not covered than you may need to seek assistance from private or govermental organization. this must be a hard time for you and your husband. I hope that both of you be blessed for being such caring people. Remember that the Lord sees and rewards those who does kindness.

If he is working and making over a $3,800 a year than you can not claim him as a dependent. He is paying your rent so that isn't a dependent either. You really need to call your insurance company as well along with your tax person. Its differerent in each state. Thats a tough one.

Not as long as he is working and paying you rent. Also, if he becomes incapacitated, unable to work and completely on government assistance; i.e., they are paying for housing, food, and medical expenses, probably not. But check with your tax accountant or the IRS to be sure.
