k... well... if someone hits your car in a parking lot and you arent there to see it happen but someone else is (according to coworker she was around corner, couldnt see much) can they file a police report or does the owner of the car have to? what if they report it and dont tell you about it? what happens then? please HELP!!

oh and i never even saw the "witness" im just going by what my coworker told me... she was around the corner and didnt see anything much other than the person i guess.... i dunno :(

If someone strikes your car with their vehicle in a parking lot, it is a hit and run accident. YOU need to file the police report yourself and list the person who saw it as a witness. You will need to give the reporting officer the witness's contact information so that she can give a direct statement to the officer. The witness would have no reason to file a police report since she is not the owner of the vehicle and has no real stake in the case.
Even if the witness did attempt to file a police report, it isn't a big deal if two reports are generated about one incident.

The owner has to file the police report. The lady may call the police and tell them what she say but is only considered a witness. She will be an asset to your court case if she actually witnessed the event and testifies in your behalf. Unless you pay the extra on your premium, most of the time the insurance deductible is more than the actual damage. You will have to definitely contact the police, insurance company, and get a couple estimates. Good luck

You need to report it with the witness info. If she (which i hope she did) get a plate number and car description then you just report it to the police as like a left a scene of an accident type thing...and to your insurance company. If the police find the person who hit your car the judge will most likely want an estimate and the person who hit it will have to pay you for damages. You basically need to report it asap... (know someone who went through the exact same thing.)

It's called a hit, and run, even though it was in the parking lot. Unless the witness was able to get a license plate number, all you can do is notify your insurance company if you want. You will still have to pay the deductible. If the damage is less than the deductible, you're stuck with the bill.

since cars & drivers are licensed per state & by the state, this would depend where you had your accident (if not in the same state as car & driver license). call the DMV or local police people & ask. there are also city/county differences when it comes to accidents & forms/reports. i don't like to be vague about this but this is a grey area with lots of shadows in legal responce. sounds like you have someone who witnessed something but not a lot but what he/she saw might be somewhat helpful. whatever, contact that person & have them write down what they know immediately before they forget . like, after time, we all get a little hazy with details & it is the details that helps the most; not the elaborate things we THINK we saw, right? good luck!

You report it to the police then report it to your insurance company. Plus you have a witness but your no fault insurance will probably have to pay if they don't have insurance that is probably why they ran.

A witness is a witness. Someone other than yourself may actually be a more credible witness in a case like this.

*You* need to file a report, asap--even if all you're doing is calling in and telling them your car was hit. If you don't, you are hosed--at the very least, your insurance company can give you grief for not filing one.
