I own/live in my own condo and rent out the spare rooms to my bro and a single mom (verbal month-to-month). The single mom has been getting intoxicated and being destructive to my property. Last weekend, she got drunk and slammed a door repeatedly, at 2 a.m., until it fell off its hinges and knocked a hole in the wall. This weekend, she got drunk, went on a bike ride and got high (with her 11-year-old left home alone while I was sleeping) and got in a fight with my bro (about the broken door) at 2 a.m. She ended up calling the police to end the dispute between the two. This morning she told me she was moving out. I need to know what kind of action I need to take to ensure that she actually does. She has severely worn out her welcome and I'd like to have her out as soon as possible. I worry about the condition of my premises and personal property due to her instability. I'm worried that she'll try trashing my stuff before she moves. Help me please!!!

You need to file an official report to the police about the damage so you have a valid reason for eviction. Otherwise you may be subject to a waiting period to evict to give her ample time to find suitable accomodation. That may be waived if you have filed a previous complaint. While you are at it though, I'd also be tempted to call Social Services given there is a child involved. Getting, high, drunk, destroying property? Wow, what does she do to the kid?

Make sure she pays for the damages done to the apartment. If she gave you a security deposit, take the cost of the damages out of that and make sure to give her a copy of the bill along with any other documentation so she can't legally try to get all of it back.

I agree whole heatedly with "stagemanics" assessment. I would add this, although contacting Social Services is a good idea, and is certainly warranted, you may want to wait until she is out of your house before you do so... Hope your able to get her out of there soon!!!
