My mom wont give me my Passport im 21 years old and shes afraid im going out of the country which i am. are there any legal action i can take to get it back?

Please help...

Apply for a new one. It is not worth the time and expense to go to court and file a police report and all that entails to get the one she has back.
You are an adult and tell them honestly that your mother is holding your passport hostage and refuses to give it to you. Since the pasport is the property of the US government, let them invalidate it and get the new one.

I'd be very upset, unless of course my parents paid for the passport.
I thinks it rediculous that your mom won't let you see the world.
You are 21 right.
I'd call her in and look for a place to live besides home, your 21 and its about that time.
Other option--- go to a local post office and ask how you can get a replacement. it should be fairly quick and inexpensive.
be sure to direct it to a P.O. box you can rent from the same post office. that way your mom can't snag the new one out of the mailbox

I asked my passport the same question and this what my passport said

1. it is unlawful for any person other than the named bearer to use this passport. Use of this passport in contravention of the passport regulations or of the conditions or restrictions set out in this passport, or for travel to countries where a U.S. passport is not valid is a felony. Title 18, U.S. code,section 1544, For further information, contact the nearest U.S. embassy or consulate or the Department of State, Office of Passport Policy, Planning and Legal Advisory Services, 202-955-0231

2. U.S. Goverment Property: This passort is the property of the United States Goverment. Upon demand made by an authorized representative of the United Sates Government, it must be surrendered.

3. Loss, theft, or destruction of passport should be reported immediately to local police authorities and to Passport Services, Washington , D.C. 20520-4818, or, if overseas, to the nearest American embassy or consulate. Your passport is a valuable citizenship and identity document, which should be carefully safe-guarded.

Can't you just get a new one, but she shouldn't just do that. Tell her that you ar a legal adult and you have the right to leave the country and demand that she give you your passport back for the convienence of not having to get another one. don't report this to the cops or anything becuase she's your mother. just make it clear that you will get a new one anyway if she doesn't hand it over. Or if you know where she keeps it may I suggest just taking it when she's not around. It wouldn't really be stealing since it's yours

Just spend Under $40 and get another, legal fees will run into the hundreds or thousands, and she could just toss it in the trash, and claim she gave it back to you. you got no leg to stand on. Yes she should give it to you, but why have a big riff over such an easily replaceable passport. It's not worth damaging the family ties.

She does not have legal authority to hold your passport because you are over the age of 18.

I myself am going to Paris in August, I'm 19 years old. I love my mother, but I never underestimate her, so I made an excuse to need my passport, and have it in my possession now.

No.

Just go to the Post Office and file a lost passport report and replace it.

Then the one she has will be obsolete.

Try to avoid confrontations with your mom; you will be happy later that you settled this and any other issues amicably.

Just go and get a new one.You can report the previous one lost,and they'll give you a new one.Tell your mom that you love her,but that you'll be fine and stay in touch.Might also want to mention that up in the air travel is safer than down on the ground travel.Not many drunk flyers up there. :) 'Luck!

I'm not entirely sure, but I think that you can get your passport because you are a legal adult. I think that's what it is. Don't count 100% on this answer.

As much as I hate to give you this advice, you can
call the police, but if your parents paid for your
passport then you should give them the money

Just remember, this is your MOTHER you are calling
the cops on.

Careful saying that you lost it, you may be committing perjury
if anything tell them that your mother has it and will not
give it to you, they can advise next steps

Just tell them it was lost, that is going to be your easiest, and cheapest route. To even ask most attorney's is going to cost you $150. for a consultation, and to take your mother to court would cost way more than it would to just apply for another one.
