I have been in alot of pain and can still hardly walk. Workers comp has almost sent me to the poor house. I can't even walk a block with out extreme pain.

of course you can sue them. You have to find a attorney willing to work on consignment, so that you don't have to pay. Attorneys can cost a lot of money. The nursing home usually has the best attorneys. So be prepared for quite a battle. Suing is not easy.

How could Worker's Comp. put you in the poorhouse? Are they not paying the bills? Then you do need to get a lawyer who specializes in WC cases. It won't be a lawsuit, they will go to court and obtain an "award" from the company. That means if your injury is legitimate, the state will make the owners of the nursing home pay all your bills and continue to pay any bills relating to your injury for the rest of your life. I know because I had this happen. One day I will need an ankle replacement and my former employer HAS to pay the bills and pay me for being out of work.

No because you are receiving worker's comp benefits. You agreed to receive those in lieu of litigation. However, you can talk to a lawyer about a scheduled loss of use/section 32 settlement. You may get a lot of money that way through worker's comp, but do not settle for anything that does not include medical treatment long term. I have seen medical bills eat through a settlement before.

How were you hurt? Was it due to some sort of negligence of one of the workers, or did you do something you shouldn't have & just happened to be at a nursing home when it happened? If it's the first, then yes probably. If it's the latter, then no. Have you been through physical therapy, etc since? That's probably going to help the most.

You usually have 1 year and 1 day from the date of injury to initiate a law suit. Contact a personal injury lawyer most of them do a free consultation to decide if you have a case. Also most don't charge you any fees unless you receive a settlement.

If it was their fault, then you have the right to sure, but if you fell because it wasnt their fault dont sure! Just because you fell down in a Nursing Home doesnt mean that it was the Nursing Home's fault. Remember what happened, and dont go suing for the heck of it! Hope you feel better!!!!

definatley especially if ur getting workers comp though it can be very expensive though to sue them $5,000 or more u maybe lucky to do a out of court settlement i belivev u have a strong case

It depends on how you were hurt. If it was an accident, I don't think you should sue. If it wasn't their fault I mean. I'm sorry about your knee.

See an attorney-personal injury. See the surgeon and see if they can help. Then immediately before anything else call a disability attorney and file for disability. do it.

yes you can sue. but you better get started, most state`s have a time limit on that sort of thing. remember to get life time medical or you will get screwed!
