You should go take care of her and have her stay with you. A 10 year old is not legally allowed to be left at home alone. The Child Protective Services authorities can take him to jail for doing this and put the child in foster care.
Go get your daughter if you can!

With the exception of 3 states they are no laws in the US saying at what age and how long a child can be left home alone. You are a parent - if you are worried that she has been home alone too long go over and check on her, if you live far away then call. Unless she is veyr very ill and in dire need of immediate medical care this is not a cps issue. I worked in child welfare for years and this came up all the time. The age and time a child can be left alone is evaluated on an individual basis. The child's maturity and ability to care for themselves vs the time period. For example older teens could be fine alone for an entire weekend this would never fly w an 8 year old. A 12 year old maybe fine to govern themselves for a few hours but they are a crap sitter for thier younger brother's & sisters, etc. 11 year olds are certified by the red cross as sitters so a ten year old alone isnt going to nessecarily raise any red flags. Take it to family court.

If your ex is the chief caretaker of the child and not you, then I would get on the phone with a lawyer and tell him exactly what is going on. Find out all about this incident... where he was, what he was doing, and how long he was out (including times he left and came back) and document it. If he has done this before, document all those incidents that you remember very well. Then, inform the ex that you are taking him to court for custody. What he's doing is illegal in all 50 states and 10 Canadian provinces. I'm sure the judge in the county (or counties) he and you live in will be able to grant full custody of the child to you. A sick child should never be left home alone esp. if she is only 10 years old. In most states it is not legal to leave a 10 year old home alone. You should report this to the Friend of the Court.

Okay, guess I will be the bad guy here...My husband and I have left our 9-year-old home alone when she didn't feel well. No REAL sick but just feeling kinda crudy with a cold or seasonal allergy. We work 5 minutes away from home and call to check on her, check in on her at lunch. That has only been a few times, because with 5 other kids, sometimes at least one of the older (18, 19, and 22) kids is around. I don't feel we are neglectful.

I understand why he is your EX!!!!!!!!!! He is irresponsible. Before you "turn him in", first, ask your daughter how she feels being left alone (write it down and/or record it). Second, find out the laws in your state. Chances are she will be considered tooooooo young to be left alone (call child protective services and ask). Then third, talk to him and ask him why the hell he leaves her alone? Assuming he lives close enough to you, tell him to call you in advance so he can drop her off with you while he is (presumably) busy and pick her up to finish out his "legal" time with her. Possibly you guys can have a more lenient schedule (than you agreed to in court) so that he can (sometimes) switch days with you that work better for him. YES, he is being a loser leaving her alone, YES, you will more than likely have to go out of the way to accommodate HIM, BUT maybe a less rigid schedule would permit him to take her on other days. Remember, your daughter is the one that counts. It may seem unfair to you but in the long run you will come out like a shining star WITHOUT even having to say anything bad about her dad..... actions speak louder than words!

Okay so your ex leaves your 10 year old home alone perhaps she had no alternative I remember being a single mom, having to work and not being able to take time off when my daughter was sick, and her father wasn't there to help out. Luckily I had a neighbor who volunteered to keep an eye on her. If you're so concerend why are YOU staying with your daugther while she is sick?

And where are you? Are you miles away that you can't be with your sick daughter? She should never be left home alone for long periods of time esp. if she has a fever. Knowing that your ex leaves her and not doing something about it makes you just as neglectful as your ex.

That is most likely illegal, depending on your state. Every state where I know the law requires a child to be 12 years old to be left alone.

tell your ex that you want to take your daughter back because as far as i can say, hes not doing his reponsibility. if she keeps staying home, your ex can get arrested because a child that is under 12, mostly is sick cannot stay home alone. what if she gets tons of cramps or faints? if your ex wont let her stay with you, hire a baby sitter.
