for dirty wall which hav,nt be painted since i,ve lived there 5 years also for a door his repaire man fixed and did,nt put up way the panel just fell out on it own.he,s also charging me for grease on the wall where the stove was for 5 years with no splash board on it ,wall paper peeling in the bathroom, sratches on the bedroom floors ,a slide lock on my bedroom door that i did make a hole in the wood to lock it i used the the pisce that came with the lock, can he do bent hinges on the cabnet doors after 5 years i have picture of every room and i will fight this what do u guys think? how do i go about taking him to court and how long do i have to wait before i file the papers?

I think these are normal wear and tear for a 5 year tenancy. Most likely a court will agree- sue him for your deposit back. Do it now.
I disagree with the writer above- YOU deserve to get your security deposit back. And to get it you will have to sue him. He is using fear of increased costs to keep you from your $$$.

Some things are wear & tear, but it also sounds like you were pretty hard on the place. The dirty wall should have been cleaned regularly- just because it wasn't painted for 5 years doesn't mean it should be dirty... the panel issue you should have talked to the landlord about when it first happened.... the wall by the stove should have been regularly cleaned, and would have been fine without a splash board... wallpaper should have been repaired, either by you, or again, you should have let your landlord know.... you can't just add a slide lock when it's not your property.... bent hinges?? They don't bend on their own, in five years or fifty. You must have bent them.
Come on, this is all common sense- you are responsible for keeping the place clean, if you weren't willing to do it yourself, you should have hired someone. Now your landlord has to go in and repair several areas, or hire someone to repair things, and it sounds like they have to hire a cleaning service... you don't have a chance in hell. Take responsibility for the damage you've caused, and pay for the damages. Take better care of your next place, or be prepared to pay again...

I went to court because landlord said that there was chipped paint on the ceilings. We had the condition report from when we arrived 6 months ago and the report said there were "marks" in places that the paint was chipped. We went to legal aid and they helped us out. There will be wear and tear after 5 years of living there and they have to take that into account. Try legal aid and see what they say. Next time take photos even of people fixing issues around the house. Make sure everything is ALWAYS in writing.

I agree with Sarah, I have been surprised by the total of repairs on past apartments, but I paid because what they charged for was in reality things they HAD to charge for. The last apartment was cleaned from ceiling to floor, I even scrubbed the deck with a tooth brush in some crevices, and was still charged alot for repairs and cleaning. Its just how it is in apartments, especially after 5 years. Now we own a home so we don't have to go through this again. I feel your pain.

When you moved in did you fill out a damage report for things that were damaged when you moved in?? If not it might be easier for him to collect the cash if he takes you to court and wins a judgement. If you did fill out a report or make notes of the things that were damaged and you noted all damage to the apartment befor moving in you will be covered. If you have pictures do you have pics of the way the apartment was befor you moved in. As for taking him to court let him be the one to fill out the papers and take you to court. expicially if you have befor and after pics and filled out the damage report.

Some items are considered "normal wear". These include carpeting and paint (not damage, just wear). Check your rental agreement. It does sound like you caused some of the damage and normal cleaning would have prevented most of it. The cost seems a bit high though.

.As a landlord myself. I consider this normal wear and tear. Especially for a 5 year tenant. I assume you were a good tenant paying rent on time? take notes of all problems ie. wall paper is falling off due to humidity in bathroom. was there an exhaust fan in there? Log every thing. at worst you should just lose your deposit.Do not take him to court, make him take you. he wont. This is a fear method. search tenant rights in your state.

your deposit should have collected interest in those 5 yrs number one number two is its not your responsibility for maintenance of the place it is his. hes adding this extra stuff so you dont fight to get your deposit and you should!PLUS INTEREST
