Unless there is a reason not to, the courts will usually give the mother custody, especially if the child is young. The father could request that you not be allowed to leave the state with the baby and that is usually granted unless there is an over-riding reason not to grant it.

the baby is american only cause it was born in america. It would go to which ever parent can provide for it the best or joint custody. I would think the courts would and can decide who gets the baby. I dont know though if one or both of you will be going home to Guatemala. If only one of you is then that person may have to give up custody if they want to go back.

You need to talk to a divorce lawyer in your area.
If you are both permanent residents of the U.S. currently, then custody is determined by the court here. If you're just here on visa's and passports without either having a green card, you'd need a lawyer to tell you the answer.

Custody in the U.S. is determined by several factors:
1) usually goes to the mother... in most cases... esp if it's an infant
2) if the mother is an unfit mother, the father asks for custody
3) if you both fight over custody, only the child gets hurt
