Both the 23 yr old and the 16 yr old admitted to the relationship
There are emails between these individuals regarding the relationship
The father of the 16 yr and the 23 yr old are in the same unit
The 23 yr olds chain of command has been notified
The 16 yr is developmentally handicapped and has a IEP and has the mentality of a 12-13 yr old
I know the age of consent in the US military is 16 BUT are there any other violations that this 23yr old soldier may have commited???
Any input on the matter would be greatly appreciated

The girl in question is mentally handicapped and has the mentality of a 12-13 yr old She is by no means severely handicapped and can self function as far as taking care of her personal needs ie hygiene, dressing herself She is in special ed classes at her high school and her curriculum is modifed
I know 8 yr old that know how to send a email in response to the person who questioned why she emailed.

That is just sick! There should be severe punishment, any 23 yr old man that would have sex with a 16 yr old girl is a pedophile!

What is the father of the victims rank. That could have some determining factors in that if he is a subordinate in the same battalion he could at very least get a dishonorable discharge it has been a while since I was in the military so I can't say for sure. But he could also be subject to state laws which could mean rape

I think the handicap works against the 23yr old. The 16yr old will probably be said to not have been in the right frame of mind or not capable of consenting to any sort of sexual relationship. Good luck

because she is mentally handicapped he is looking at rape charges and it will go through the army not our public court system why would he want to have a sexual relationship with a girl with the mind of a 12 year old child that is really sick he has some problems i wouldn't want him around any child i hope he does get time in prison he took advantage of a little girl

Not looking good here most likely headed for a courts-martial and not just an Article 15. When I was in charge of these actions this would have brought about 3 to 5 at Ft Leavenworth.

Under the age of 18 on a military post is statutory rape, the fact that she is handicapped makes it enhanced (some places call it aggravated)
You did not say where this allegedly happened, he could be facing civil charges is most states if any of this happened off post.

you say the girl is mentally handicapped? why would she be emailing? i think that the military should first of all give the soldier a dishonorable discharge, then let the father of the girl know what happened and then the soldier will most likely spend many years in the pen...

He can lose everything he worked hard for, especially his honor and integrity. Is he prepared for that? 16 although a Teen and who is mentally handicapped, still has a mind of a child, I'd say your friend is looking for some serious jail time.

Well, he was on pretty solid ground, at least criminally, until you said she was developmentally handicapped. That makes it rape! I think the soldiers butt is cooked!
It is statutory rape for someone under the age of 16, but it is rape with someone who is a child and is cognitively functioning as a 12 year-old. In my state it is called 1st degree sexual assault.( and that is for each offense). Then there is Conduct Unbecoming!

Definitely a dishonorable discharge, trial by courts-martial and jail time. It's unavoidable and shameful. This man is a pimple on the *** of military progress.
