Not only is it illegal, you and he would be committing perjury if you did it. He would be in effect taking the real father's rights and abilities to be a father to his child away. It may sound like a great idea now, but my brother-in-law did this. He and his girlfriend broke up a couple months later. Then the state went after him for child support, but the baby wasn't his. The father was the boyfriend she went back to when she kicked my BIL out. It ended up going to court and the only reason they didn't both go to jail was because she was underage when the birth certificate was signed and claimed she didn't understand what she was signing. If you don't have agreat relationship with the father, you are better off leaving it blank.

The pain to the child when s/he is told that she's not his kid is a testament to how vicious this cycle becomes. Since about 1/3 of kids are born to unmarried mothers, I think this is a good idea. Only the biological parents are allowed to sign the birth certificate. If you want yur boyfriend to be the "father" then the child's biological father will have to sign away all parental rights and your boyfriend will have to adopt your child. Keep in mind that once this happens you can not go to the biological father for financial support.

It's not illegal, but is the biological father aware that he is the dad, or not? If he is not aware, I guess it wouldn't hurt anything. But if he is aware, I would think you would need to discuss it with him first and ask him to sign over parental rights.
Just think of it this way - they don't ask married couples to submit to DNA tests at the hospital to prove the baby is really the fathers'. He just signs the birth certificate. They don't know if the mother could have been pregnant by someone else, and they don't ask.

I don't know about your state but in mine he could sign it.My bf who is not the father of my daughter wanted to sign the birth certificate.I talked to a lawyer and he said if he would of done that he would legally be considered her dad.If we ever broke up he would have to pay me child support not her biological father(that is if I took him for it)and if her biological dad wanted something to do with her legally he wouldn't be able to.
