I will explain this to you in clear medical terms. When a woman is not ready for sex, her vagina is not moist, therefore the penetration will hurt her physically. She will also be subject to great emotional pain: just think if a man raped you. How do you think you would feel?
Any person has his/her private space, which may be bigger or smaller. Some people will not feel comfortable being touched even if they are on friendly terms with you. If a person does not invite you into their private space(by gestures or words), then you are invading it and you will see that from the person's reaction: they will withdraw or become aggressive. So, before you do anything stupid, think of the consequences and put yourself in the other person's place. How would YOU feel if that happened to you?

OK.. Rape is the unlawful "Penetration."
Meaning- If one is underage- that's why it's called statutory rape- the age makes it unlawful.
So if a condom is used or not, it's not going to matter. It's still unlawful.
I believe they now call rape CSC (Criminal Sexual Conduct).
(I know at least in Michigan-In fact.. To be charged with CSC in Michigan there doesn't even need to be any penetration)
There are many degrees..
1st Degree CSC
2nd Degree CSC
3rd Degree CSC
4th Degree CSC
As in 1st being most serious and 4th being less serious.
I believe this answers your question so I won't explain the degree's.
Edit----- 5-5-07
To the person below.. I said "Unlawful" so.. yes, a wife can place a complaint about her husband.. all she has to do is say no, and then it becomes "Unlawful!"...... next time read carefully so I don't have to explain myself again.

Definition rape is, the sexual activity took place by force or it was not consented. If one party objects to it, it is considered a rape. Even if you touch a genital part and did not have any sex, it is still a rape. Get it? Rape is a rape, there is no if and but about it.

Yes it was rape.
Rape is forcing someone to have sex. It can be forced oral copulation, or rape with a foreign object, as well.
Wearing a condom is an attempt on the part of the rapist to keep from leaving DNA evidence.

yes, it will, if the sexual act was against the will of the female and or force was applied to make the female accept the sexual act. However law does not consider rape to exist between spouse. So condom or no condom if the female claims it to be rape then it is rape untill and unless court decides against it considering all the evidences.

No idea what a "condome" is. But it's rape because penetration occured. My state law is written to say that any unwanted penetration, no matter how slight by any object is considered rape.

Rape is anytime anything enters the body without permission. If you force a popsycle stick in someone's mouth it's rape. So just because you wear a condom it's not sex, or penetration? Yeah, that's idiotic, I'm sorry. Go turn yourself in if or whoever you're asking this question for.

It is still Rape. The law most often defines Rape as "Penetration of the vagina or anus by a penis without consent". In many jurisdictions, this is expanded to include any other body part such as fingers, tongue, a fist, etc.

If the condom were found, it would have the DNA of both individuals on it.
And how can you say there is no contact? A full body condom?
