I think that it IS 'God' granting the pardon and it IS 'God' granting the special dispensation. God working through us. Namaste! ( the god in me sees the god in you).
(Sometimes the 'GOD IN ME CANNOT SEE THE GOD IN YOU' for various reasons - maybe personal things get in the way - and that 'colours' the decision we make at the time.)
Why did God let Jesus die the way he did? I look at it this way - It was Jesus's choice to engage the roman authorities and church elders in the first place - could he see the God in them? - if he couldn't, then they couldn't see the God in him.
result - untimely and painful death.

1. Yes, he was able to do that, if he wanted.
2. It probably would have been better for his son not to die in vain.

No matter what God did, someone would ask "why?" God is infinitely able to do His will. It was His will that His Son should die. Should, you, his Creature think that you could have found a better way?

2) He would have been in violation of His righteousness and justice...for He is both just and righteous.
