Judgments are based on the evidence & circumstances of the case not only on the FIR. Basically what if FIR? Its only the first information report the police officer receive for an offence & based on this information the investigating police officer starts his investigation under the order of the magistrate. Whatever evidence he collects during his investigation is brought on records of the court & based on these evidences the court comes to a conclusion regarding the offence that is pleaded to be committed by the accused. If the FIR is fabricated the obviously the evidence brought on record will also be fabricated, the authenticity of any evidence brought on the record can be checked & cross checked at the time of process of evidence examination in the court which if found fabricated will get the accused discharged from the charges framed against him & such a criminal complaint will be dismissed immediately by the court, along with strictures against the investigating agencies i.e. police for which departmental inquiry is always initiated.

As a cop who does his job, upholds the law, and tells the truth even if it hrts the case, I resent your remark. A we as a whole are sworn to uphold and hold the law true. A prosecutor is also sworn to do the same.

Believe it or not, your right to say what you have here is guarenteed by law and those of us who uphold it so if you had a bad experience, than I am sorry. There are those few bad apples that make life difficult for the rest of us.

Judges give verdicts based on evidence presented.Cops are supposed to collect them and process them correctly.Prosecution is supposed to ensure that the culprit is punished for his crime.
These two arms of the law are supposed to work in favour of it.Unfortunately circumstances force us to believe otherwise.!!

First Information Report is not a substantive piece of evidence. It only sets the law into motion. After FIR, the police investigates the offense. During investigation, many new facts come to light. Some times the whole nature of the case changes, new sections of law are added or deleted.

Unfortunately very high majority of Indian Police officers are corrupt, dishonest, inhuman and act upon the instructions of such superior officers and political leaders. They usually fabricate false cases after much planning to involve the very innocents. They save the real culprits and criminals. The Asst. Public Prosecutors and Public Prosecutors always support the police cases.

Thousands of obvious murders of innocent people committed by the policemen every year, under the instructions from their superior and their superior officers are simply hushed up as armed encounters between those policemen and murdered innocent naming him a criminal. A Post Mortem detailed case history of that murdered innocent is then prepared, labelling all the undetected cases to him. Usually policemen pick up those innocents from their houses from different locations, confine in their lock-ups, torture brutally till death and then bring the dead body to some isolated place and shoot at it. Police doctors also always support the police version. The whole Police department then threatens the blood relatives and witnesses of that murder to keep quite, challenging of their deaths also likewise if they open their mouth.

Three senior Indian Police Service officers in higher positions of Superintendent and Deputy Inspector General of police are now arrested and kept in police custody for the Gujrat fake encounter (really Muslims' murder) when the brother of slain knocked the doors of Indian Supreme Court for investigation through the Central Bureau of Investigation. However those policemen are not suspended from their superior posts in police dept. despite their remaining in police custody for about a week. The Indian law commands that each and every government servant is necessarily to be suspended if he is in custody for over 48 hours. The Gujrat government is so kind upon them. After murdering him, the policemen raped his wife (eye witness of murder), burnt her alive, digged a hole and buried her remains.

The same policemen picked up three Muslim boys and one Muslim girl from Mumbai (Bombay) from their houses in the different localities, brought them to Gujrat State, tortured brutally till death and shot gun bullets upon their dead bodies, claiming they had planned and come together to Gujrat to assassinate the Chief Minister.

The same policemen picked up many Muslim boys from Hyderabad without leaving any evidence of their kidnap and murdered after continuous brutal torture by all means. Gujrat government with Narendra Modi as Chief Minister always appreciated them with promotions and rewards.
