Definitely there is remedy available for such cases. Many a times constitution writs have been filled in the Supreme Court of India & even in various state High courts regarding release of those victims who face criminal charges & are already served the maximum amount of imprisonment in the jail during the trial stage itself & the learned courts have got such under trial victims released immediately. If you know about such a case file a writ of habeas corpus in the High court of the state where the such a person is facing imprisonment in jail for fabricated FIR or served jail imprisonment for term that was maximum for which he could get any punishment in an offence.

I don't know what f.i.r. is but I do know that there are organizations that help with this. I have those somewhere in my notes just in case but would have to find them. What were they accused of and why did cops do that? I know several people that were set up and one that was sent to a max prison to wait for his trial after he was held for 2 months without bail. This was due to our efforts to stop a serial rapist cop. If you have time listen to the interview on this link http://nodonut.egoweblog.com/blog/bad_cop_no_donut/program_details/2006/06/15/bcnd_jun_15
I went up against the same sort of thing. Many people won't help because they are afraid of going to jail on trumped or fabricated charges. my email and im are open. I bet it scares the cops when I teach people what I did. Good luck, T

Only a very EFFECTIVE intervention by the Lawyers (Bar Association, Other legal forum) could prevent this. The persons who are charged with serious criminal activities ( like killing of people, association with Terrorist) are roaming with Bail whereas even a 2-year old child had to be in Jail for a primafacie false charge drafted by Police. Judiciary, although they are overloaded, can also interfere with suo-moto proceedings against all such activities by the Police especially. IN OUR COUNTRY, THE FEAR CHAPTER FOR SOME SPECIAL CATEGORY OF PEOPLE IS NO LONGER EXISTING. SO LONG THERE IS NO FEAR FOR PUNISHMENT, THERE IS NO REMEDY.

Sadly in the US just being innocent is not grounds for an apeal. If they have proof of the fabrication, they can appeal, or petition the governor for a pardon
