So sad when some cops are ignorant of the law but talk from a position of authority. Select-fire weapons are legal for individuals to possess in all states except DE, DC, HI, NY, and WA.

No license is required, but a one-time $200 tax stamp is necessary to purchase the firearm. It's not as easy as just paying the tax; first you have to apply for the privilege.

Your first order of business is to go to a Class III dealer and pick a firearm you like - you'll need the serial number for the form in the next step. Then you need to fill out ATF Form 4 (5320.4) and have the chief law enforcement officer in your location sign off on the form. This, unfortunately, is where most people's applications die. Then, after a lengthy background check, you will be issued the tax stamp and will be allowed to complete the purchase.

Click the provided link to order ATF Form 4 (5320.4) online. There's no downloadable version; you'll have to wait for a paper copy to arrive via mail. It doesn't take long.

You find the gun you want (you have to be 21 to buy it from a dealer, but 18 to buy it from a private citizen in your state, your most likely going to find one at a Class 3 dealer shop). Tell the dealer you want it, do the regular NICS check, and pay for the gun. Go to your local sheriff and have him sign off on it, send your signed papers, 3 passport photos of yourself, and a set of finger prints to the ATF (there is no official waiting period, you are waiting for the ATF to file all the paperwork, a friend who collects NFA items said that the shortest wait he has ever had was 2 weeks and the longest was 9 months). Pretty much if you can own a handgun you can own an NFA weapon. Just make sure its legal in your state.

To follow up on a prior poster's correct explanation, if you can't get CLEO signoff in your area, remember that businesses can buy class 3 guns as well as individuals. You can form a company to buy the gun. This is very easy to do, any attorney can do it if you can't figure out how to do it. The company can buy the gun without CLEO signoff.

Visit a class 3 dealer and pick out a piece. Any class 3 dealer will walk you through the entire process (because they want the sale).

Sorry about Deputy Fife and his disinformation.

Thank you Manevitch! You saved me a bunch of typing! Especially when you commented about uneducated deputies.

You cant. If you are with a government agency or law enforcement agency, you can apply for one through the ATF. Its pretty pricey. Don't think you will be getting it. Sorry, bub.
