of course because when you stop there is no light up effect for people to see and not everyone can distinguish if a cars brake lights are stuck. so in effect if you have an accident the police can check your lights. why would you not get it fixed, chances are you need a new spring on your pedal or something use a bungy cord man its not rocket science its somebodys life.

If your car is behaving the way you stated, the wiring is totally screwed up. Brake lights are not tied into the ignition system - get into any car (with working lighting) and push the brake pedal and the brake lights come on - key in, car running, or not.

Get it fixed - or it's only a matter of time before you get a ticket or rear ended. Quite frankly you deserve a ticket if you are aware of this problem and do nothing to correct it.

Brake lights or tail lights?

Tail lights, like if you drive around with your headlights turned on would not be any problem, even in full daylight.

If your brake lights stayed on all the time, as if you were using the brake even though you are not, would be a safety hazard, as no one behind you could really tell if you were actually braking or not. A cop can ticket you for a safety hazard.

If it really is the brake lights, don't wait for a ticket. Fix it before you get rear-ended, causing damage and or injury to both you and your car, as well as the poor fellow behind you.

Yes, it is called defective equipment. Even worse you could get yourself killed because the guy behind you doesn't know you are stopping and hits you very hard.

There is usually a little switch attached to your brake pedal, or a hydraulic switch in your brake master cylinder that if it got dirt in it, would hang up and keep them on.

Look for these two possibilities, and either repair or replace them. Probably won't cost you 20 dollars, and that is a whole lot cheaper than you will get off it cited.

Yes you can get a ticket, because since they're always on you no longer have any brake lights to warn people behind you that you're stopping. It's just like having no brake lights.

There is a switch connected to your brake pedal that tells those lights to go on. Find and replace that and it should fix your problem. It's actually a pretty easy replacement on most vehicles. Good luck!

Yes, you can. Brake lights are intended to tell other drivers when you are stopping or slowing your vehicle. If they're defective, they aren't doing their job and you can get in alot of trouble for it. Lucky for you, it sounds like a wiring problem, which I don't think costs alot to fix. I'd do it soon, because it is legal for them to give you a ticket for defective safety equipment.

You betcha! It's usually a "7-Day Fix it" ticket. If you bring proof of repair to the police station or the court it will be dismissed. If you don't, you'll be hit with a defective equipment citation.

I don't see you getting a ticket unless the cop was a real ******. I suppose he could give you a ticket for defective equipment if he had a reason to.
