If my father remarries at 70 and makes out a will saying that my sister and I get the house and power of?

Your father can designate who he wants for power of attorney. He can also leave anything to anyone he wants to in his will. However in some states there is a custodial support issue. Depending upon how long they are married, she would be entitled to something and if the house is his only asset at the time of his death, there may be some trouble. He may want to consult a lawyer. She probably is a perfectly nice woman who would do what he wants on his death, however, what if she is ill by then too? No telling what her family may try to do. Make sure he does not put her name on the house either during their marriage.

Your father would be well advised to seek a lawyer's advice as far as what his wife would be entitled to though when he dies.
