On the 2nd of April I rented out a DVD from a video retail store and returned what I thought was complete box and dvd to the store the next day. However the video store rang me today telling me that the dvd has not being returned, they then mentioned that they have been trying to contact me via telephone for the past few days but I have not recieved any calls from the store what so ever. I do now think it is still in the DVD player. I have to call into the store after work, but I have been told I am facing over €60 worth of fines?!!Do I have any come back?

About your only come back is to bring the disk back, tell them "oops, I must have left it in the player", and if you smile and are personable enough they might cut down the late charges. Otherwise, just pay the late fee and try to remember to check the box next time before you return it.

Over here in US, the cost of fine cannot exceed the amount of the DVD itself. Meaning if I don't return for a whole year, they cannot charge me daily up to a year. They can only charge me for what ever the DVD's price was at the time of the rental.

Tell them it was in the case when you returned it, and that they should go swing for it. They will ban you for life, but it is their word against yours. Then slip into the shop to complain and slip it under their counter when they are not looking. That way you can demand an apology when they finally find it.

You could try appealing to their better nature and point out that it was a genuine oversight.
Ask to see the policy on late returns. If their terms are clear and you have agreed to them in writing (and they are one of a large chain like Blockbuster) they could well push it as far as County Court level.

if it is in your dvd take it to the store and apologise tellthem you have not received any phone calls, if they persist in trying
to charge you tell them you will go to the trading standards with your telephone and prove you had not received any calls
that should call their bluff, whatever you do stay calm and don't shout and scream.

This why I take them in and have them check them while I am there. You are at a disadvantage, ie, your word against theirs. It is not worth them filing a claim against you. Some video places have even filed a police report for theft.

get in touch with the c.a.b. they will give you some information on your consumer rights. or as above return disc with apology and hope for best.
