My boyfriend and I have a 6 month old little girl together and we are currently in the process of breaking up. He is going back to his home town in Alabama and I live in Ohio. He doesn't want to get custody, but he wants to be able to see her, which is fine with me, but I don't want her going to Alabama. Can I prevent that from happening? What kinds of rights would he have living in a different state? How would the visitation work?

You really need to talk to a family attorney and share your thoughts with him or her. The attorney will be familiar with the law and what you can and cannot do.

well usually out of state visitation says that the non custodial parent gets the child 1 week over christmas, every spring break, and 6 consecutive weeks over the summer. (even if your daughter is not school age yet). unless you have good reason such as neglect or abuse, you probably will not be able to prevent him from taking her out of state. a new law says that even if he doesn't pay child support, you can not prevent it. children need exposure and guidance from both parents. im sorry for how you feel and for your situation, but he is going to be allowed to take his daughter to his home. if you fight it in court, it will be costly, as you will have to hire an attorney ($200 an hour) and so will he. and if there is no abuse or neglect, you are not going to win. they will say there is no valid reason for him not taking her out of the state.

you cant deny him access whether you are the custodial parent or not. Right now courts wont take her out of state b/c of her age, but when she is older they will award him at least 2- weeks over the summer and ever other school break and holidays and she will be allowed whether you prefer it or not, to go to her fathers home in whatever state he lives in

i can help because i went through the same ordeal for about 12 years. i am from ohio my ex is from Ga. It is hard to have a long distance relationship with your children if they live in a differnet state

THE CHILD SUPPORT WILL GIVE U A BREAK
DOWN ON VISITATION RIGHTS, DAYS, HOURS
AND HOLIDAYS. AND IN THIS PACKET IT WILL
ALSO HAVE A BREAK DOWN FOR THE OTHER
PARENT WHO LIVES MORE THAN A 100 MILES
AWAY. I HONESTLY FEEL THAT IS THE BEST
THING U CAN DO FOR YOUR BABY GIRL..
I WISH YOU THE BEST AND WHAT EVER U
DO , DO NOT BACK DOWN IF HE BEGINS TO
MAKE THREATS , BECAUSE U FILED FOR
CHILD SUPPORT. SOMETIMES THEY TRY TO
SCARE U THAT WAY THEY GET AWAY WITH
