It's illegal except for specified exemptions - have a look through the federal Telecommunications (Interception and Access) Act 1979 at:

I can't recall the name of it but if you do a search on austlii you should bring it up - but there's a case (High Court?) which said that if you held a tape recorder to the earpiece, you are not breaking the law, as you are not intercepting the electronic communication - so you can record a phone conversation like this without letting the other person know.

I have a friend who is in charge of phone tapping for the Federal Government and he said some time back they only have to have stand up in court proof of suspicion and they can tap a phone . This has come since the terrorist laws were changed.~~

If you want to tape the conversations you have on a phone you have to tell the other person or they have to tell you if they want to tape you.
The exception to this is if they are in Law Enforcemant and have gotten a court order to tape you with out teling you.
