Legal help. I need to serve someone, I'm in Arizona and she's in Alabama...?

Question

If I serve her through certified mail, is this good enough to set up a court date? What if she doesn't show up for the court date? What if she's doesn't have a job or nothing at all? I feel like it will be difficult to sue her since she's in a different state...

She owes me more than $10,000 but the limit in AZ is $2500 that's why I said she doesn't have a job or nothing...I have statements stating our agreement she'd pay and she ran off to Alabama

Hello, first of course you have to be sure you are sueing her in the court that has jurisdiction, if this is where you made the agreement, then it is ok.

But you file your suit, and have her served according to court rules, often it may have to be personal service, so you merely hire one of the companies that do legal service, there are such companies in every major and most minor cities. Your court may allow certified mail service, but you will have to varify what your court allows for its legal servcie,

If she does not show up, you can ask the judge to give you a summary judgeemnt ( you win) the other side can appeal this.

But now this is the issue, 1000's of people win court cases, but never get thier money, once you win, now you have to find thier money if they have any, do they have money in the bank, if so you have to find the bank accounts and attach them. If they are working you have to find thier job and garnish them.
If they have no money, and have no job, you most likely will never collect any money from them, even after you win the judgement, So you have to balance how much you think you can win, by how much the law suit is going to cost you in court fees, legal fees and the such

Upon the filing of the complaint or other document required to be served in the manner of an original complaint the clerk shall forthwith issue the required summons or other process for service upon each defendant. Upon request of the plaintiff separate or additional summons shall issue at any time against any defendant.

My suggestion is you determine what county the person who you're attempting to serve resides in! Contact that county court clerk to determine exactly what is required for service from out of state.

Why would you care? If you're serving here, serve her. Some services via mail are legit, but its all dependant on the type and court. Read it well.
