I came off of active duty in Dec of 2006,i am now on reserve status with the marine corps. I had a 2006 toyota Tacoma when i joined and got behind,i paid it up when i came home in june from boot camp but got behind again when i left in july for trainning and came home in dec. My truck has been taken this morning but i was told by my unit i should have 6 months to catch it up. Can my truck be taken or should i be given the 6 months to pay for it. I have been giving double payments for 3 months now.

The Soldiers and Sailors Civil Relief Act is intended to lower interest rates, and protect you from civil suits while you are deployed. It is not intended to give people a furlough from paying their bills. I'm afraid you got some bad advice from your unit. The bank was well within their rights, legally, to take your vehicle. Sorry.

SSCRA doesn't cover any debt acquired while on AD. It only is there to alleviate the financial hardship that happens when a Guard or Reservist is called to Active Duty and their civilian pay was much higher than their military is. any lender does have the option to refuse to apply SSCRA if you are delinquent or if they can prove that it is not a large hardship.

you should have worked something out with the lender BEFORE you went off to training.
