Ok, this is what happened-my friend was in an accident in her boyfriend's mom's car. The accident was not her fault, it was the other drivers fault. The police officer did not write my friend a ticket for not having a license. The boyfriend's mom's insurance told her that the other driver has to pay to fix the car. The other persons insurance is currently investigating. Will the other insurance company find out she doesn't have a license even though the cop didnt give her a ticket fot it?

Well the accident itself was directly caused by the other person but your friend was also guilty of what is called contributory negligence since, because she has no license, she is not supposed to be driving. Had she not broken THAT law, the accident would not have happened. (Which also means that your friend was not insured either since no insurance company insures unlicensed drivers)

Ticket or not, the insurance company will discover this as a part of a routine investigation into everyones driving history and may use this information to factor into a settlement offer. The mother may find that her policy is cancelled, and future insurance would then be a bit more costly.

Your friend can be very happy that no one was hurt or it is almost a certainty that, right or wrong, someone would be suing the mother for loaning her car to an unlicensed driver.

A lot depends on the actual circumstances. just because the cop didn't write a ticket for no license, does not mean that blame does not rest with your friend. If get sued / or tries to sue, a judge or jury may find that your friend was 50% (or whatever) liable for being behind the wheel when they weren't supposed to. If they weren't behind the wheel, then they couldn't have gotten into the accident.

And yes, the other party's insurance company will find out that your friend did not have a license at time of the accident just from information on police report (Name, DOB, Address, Social Security, etc) that they can run a status check on through records at department of motor vehicles.

Any time there is an accident, someone is at fault, accidents do not "just happen". The two insurance companies will investigate and decide who is paying what. In rare cases when they find both parties equally at fault where the money being paid out by each would be the same, they may tell both parties to pay for their own damages.

Yeah, whether it was her fault or not, she was illegally operating a motor vehicle so the cop at the scene may have let her off, but you can be sure that the investigation will uncover this and both she and the officer will be in trouble. Good luck! She shouldn't have been driving without a license.

The ins co will find out about the not having a license.

It will be a royal mess, the ins co will probably cancel, and LOL getting insurance at an affordable price anywhere.

The police and ins co's will determine who is at fault and who will pay what.

99 out of 100 times if they do an investigation there looking for anyway to get out of paying,so most likeyly they will catch you if you dont hav a liscense ur not insured or anything like that,insurance companys are very smart,but not to keep ur hopes down its possible they dont look into it good luck

it is quite likely that they will find out she didn't have a license and therefore it will become her fault and it is highly unlikely any insurance will pay for the repairs

legally you should not have been driving and therefore are not covered by insurance so you should be liable for the repairs to both cars and any fines, if it goes to court.on the other hand the insurance company might just settle... pray for good fortue.

my girlfriend got into a accident not too long ago.she was hit by someone she did have insurance but no drivers license. she said they never checked into it and never said anything to her. they other drivers insurance company sent her a check for her damages.
