Tell him/her if they keep pooping there underwear, you'll make them wear a diaper until they stop. And if they do it again, stick to your word. They'll know you mean bussiness!

My daughter also has this problem. I don't really believe in making kids sit on the toilet for long periods of time, so right now we are using a combination of telling her how proud we are of her when she goes on the toilet and giving her an earlier bed time like her brothers, who are still in diapers, when she does have "accidents." We tell her that the earlier bed time is not a punishment, it is just a "rule" in our house that people who do not use the toilet have to go to bed early. We've told her that the reason for this is that the adults have to have extra time clean up the messes made when people don't use the toilet.
The other thing you may want to consider is that it is something personal for him. Many kids have a problem pooping on the pot. My sister admitted to me when I was talking to her about my daughter that she was afraid to go poop on the pot until she was 6 or so. I know other children that get so busy with what they are doing that they don't want to get up and go. Some kids don't go because they have problems with constipation and it hurts. Also, if he used to use the toilet and doesn't now, there may be something stress related.
If you do not find anything else that helps, ask his doctor.

He's a bit too old for not understanding the potty training concept, (not being ugly by no means) Have you talked to his pediatrician about this? I could be a medical problem, not being able to control himself, etc. If he goes to daycare, maybe you could ask what he does there, or if he does this only with you. You could try rewarding him with something (like I potty trained my daughter with gummy teddy bears, but we called them potty bears and she only could eat those when she went to the potty. Good luck with him and hopefully it is not a medical issue and only a mild childhood issue.

First talk to your doctor to make sure there are no physical problems. Also, it is never advisable to make a child sit on the toilet for prolonged periods of time.

first stop posting this three times. once is enough.
first find out why he is doing this, see the doctor and have his bowels checked. kids tend to try and hold it in when it hurts to go. this could be the problem. figure out the problem. once you know why its going on it will be easy to correct

Have you tried making him sit on the toilet for extended periods of time? He will learn to use that instead of his pants if sitting on the toilet prevents him from doing what he wants, i.e., playing.
