They can do it and not get into any trouble. This was part of the American peoples civil liberties they decided they could do without under the Patriot Act. They can be called terrorists and if they use the Military Commissions Act of 2006, throw them in jail, have them declared "enemy combatants" so they cannot get access to attorneys and hold them without charges until they either feel to charge them or let them go and there is nothing the formerly accused can do about it.
