My son's truck was stolen from the apt. pkg. stall, & the police found it miles away, stripped, totalled. It was too old to really have FULL coverage, so theft wasn't covered. But he made a police report right away & was told they would call "him" if it was found. Instead it was abandonded on the side of the fwy. & the nearest city was called to tow & impound it. He had to pay the towing company the fees for impound & towing when he was told he would be called. After looking at it, & having to replace it, why shouldn't they have called him, (the police, or highway patrol)? That would have saved him a lot of monies, & now he feels like he was ripped off twice. Anyone know the rules for California?

Remember, that the CHP is primarily charged with keeping the freeways moving and safe. The CHP may try to call the owner of a dead car, but if in their opinion the abandon car represents a traffic hazard, it is towed. If the car is off their jurisdiction but blocking the exit or onramp they will request the City agency to clear it.


He can file a claim with the agency that towed it, but odds are really good that he will lose. Still, filing the claim is free and you never know.

I hope that he at least got back a car he can repair and use.

You can look into your city or county towing regulations. See if they are regulated by any ordinances. Call your insurance co. to see if there is anything he will be reimbursed for. Even though it is old, if you are paying insurance, it should cover some. It just depends on the company. You can also go to the agency (police or CHP) and see why they had it towed before calling your son. If it was a traffic safety concern (parked in the road or another dangerous place) they probably would have done it without calling him but if it was on the side then they should have called him.

The local small towns have their own ways of removing abandoned vehicles. This could include impounding it without even contacting the police. The vehicle SHOULD have been towed to the police forensics lab for fingerprints and other evidence to catch the thief. You should contact the town that towed it and show them the police report, and try to get the fees reversed. Problem is, if they were already paid, there's much less that can be done.

I would have done something about it immediately - even if the car wasn't worth anything.

Even though they told you that they would call you - you should have had it towed, or gone out and limped it home - or worst case - pulled it with another car.

Nothing can be done now.
