two nights ago i was hit by a drunk driver. he blew a 1.4, or maybe a .14 im not sure, but anyway the police charged him because he flew threw a stop sign, hit me, and then i went head on into a pole. i was okay other than a slight concussion, but my car is totaled.

i dont believe he has car insurance, and i only have liability. am i going to have to by myself another car? if so, this is completely rediciouls. i get off work just to go home, and an idiotic drunk driver hits me and now im left with no car?? answers please??

The choice to have liability insurance only is yours but check with your insurance company to see if you have any additional coverage that may apply to this accident since the guy is at fault.

Hate to tell ya this but it is what it is....this is a perfect example of why you don't just carry liability insurance!

If he has no insurance, and you have liability, you are correct, you will have no car. If you carried uninsured motorist coverage, along with the liability, you still would have the car issue because you don't have comp/coll coverage. You can sue the other driver, get a judgement and garnish his wages, however, if he quits his job, you have to reapply, if he skips town, you have to track him down. Basically, if he doesn't want or care to pay you, he won't. And, unfortunately, he can get away with it, if he doesn't care about credit ratings, or courts, why should he care about you?

He's liable for the damages, unless you live in a no-fault state. You'll probably have to sue to get anything from him. Small Claims Court may be the way to go if the value of your car is near or below the limit for your state.

For whatever small consolation you may get from it, in most states you can get his license pulled until he pays for all of the damages since he was driving without insurance.
