I have been with my partner for almost 2 years now and we are planning to get married.
She has a wonderful 5 yr old daughter whose father has no contact with at all. For almost a year now she has been calling me dad.
Question is. I would like to adopt her when we get married, The fathers name does not appear on the birth certificate. What procedures do I need to go through?

Depending on the state, if in the US, you might not need to get an attorney, contact the local courts, usually the Family or Chancery Division, and they should be able to answer most of the questions you have. There is a document called an Absconding Affidavit in which your partner would attest that the child's father hasn't had any contact or support in I think it is five years, so he absconds his rights as a father and then I believe you can go from there with the adoption. Don't run to pay an attorney if you don't have to. Also try on-line with regard to certain forms that might be required. It really doesn't have to be a complicated matter if it isn't. Without knowing what state you're in, the most general answer is all you can expect. Either get a lawyer who does adoptions or go the family or probate court (or whatever it's called in your state) and ask for the forms to adopt her.
Chances are you will have to file a petition to adopt her and give notice to the father by publication (legal notice) in a local paper (where the father last lived or was living when the child was born. The court is not likely to accept an argument that the child was a virgin birth, so the fact that he is not listed on the birth certificate may not make much difference.
If no one files an objection, your petition will be allowed. Whether there is an objection or not, you may still have to go to a hearing.

You will need to get a family law attorney & a copy of the birth certificate. Take this to the attorney to request a court date & get the ball rolling.

Petal, if you are a woman, why is this kid calling you 'dad'? This is a bizarre story if that is the case - and you are two lesbians playing house with her child.
The child will grow up and find her dad. She will eventually realize that you have not got a penis but you would desperately like to have something that makes you 'dad' - like. That 'thing' is her.
This is not about this child. This child has a mother. This is about you - she is the equivalent of some fantasy you have to be a guy.

Well here are your answer....First of all if the name does not appear there should be no problem...but if the father's name apparear the farther woudl have to resigned as a father then you can adopt the baby.....i informed myself so i know alot about it .....Good Luck

I don't think you really need to do anything other then contact a lawyer and get the ball rolling, if your partner is asked who the other parent is, tell her to them she don't know, that way there is no signature to obtain and no strings or fuss!

you will have to talk with a lawyer. they are trained to handle these situations. when it is time set up an appointment with him or her. he or she will help you.
