does H&R block have to pay me if they messed up on my taxes...they didn't file for my state taxes..i called the irs and they said there is nothing on file there of it and that they never filed for it that is why i did not get it

h&r block filed my taxes and did file for my state and there was enough to get back....but i called the irs and they said there was nothing on file of them filing for it

Most paid preparers don't actually file your taxes for you. They prepare them for your signature, and although one of the things most of them prepare is a pre-addressed envelope, you still have to mail it yourself.

Even if they didn't send it to you, you should have followed up on it, because it's your responsibility. I hate to give you bad news, but it sounds like you dropped the ball.

Are you saying there was nothing on file with the IRS for federal? Look at your copy of the form and see what it says. If they gave you a separate sheet to sign while you were at their office, then it would sound like they intended to efile them. If they gave you two copies of your tax return, you were probably supposed to mail one of them. In either case, they should have told you exactly what needed to be done. Also look at the packet they gave you and see what it says it should say what you were supposed to do if anything.

Unless there's something really strange about your return, or you told them that you didn't want them to efile your return, I'd have expected that they'd efile it rather than your having to mail it.

I assume by now you've called their offices - they should have a record of which they did.

If you have a refund coming, and it sounds from your question like you do, there won't be any penalty for just filing it now, late, so there's nothing for them to pay you for.

I'm confused from your question as to whether you didn't intend for them to file your state taxes, or if you thought they did but they didn't (the IRS has nothing to do with state taxes). Again, look at your packet from H&R Block, and if you can't sort out what did or didn't happen, call them and ask. And if they were supposed to file your state but didn't, and you end up getting charged a penalty for filing late, they should cover the penalty.

I believe that H&R advertises that if thye screw up they pay for their mistake. I sort of doubt that it is true but it is worth checking with them about. If the state return didn't get filed then just go ahead and refile it. We don't live in a perfect world and mistakes happen from time to time.

First of all you need to find out if your income was high enough to be required to file state taxes. They may not have filed if you did not make enough to be required to do so. Next you need to contact them and work out the situation. They have customer service to handle such problems.
