If they call that late then you can file charges on them for harassment. This is unacceptable behavior. Also collection agencies make a lot of threats, but they have little real power. Sure they can file a lawsuit, but that will take a long time and a lot of money to do. Collection Agencies make half of what ever they recover. This means the company you owe the to has just signaled that they are willing to accept payments from you for 60 cents on the dollar.
What you should do is call a Debt Relief or Consumer Credit Counseling service. Many of them are non-profit and they can represent you with the company. Declaring bankruptcy is a lot harder now days, but you could file chapter 11 (where you only have to pay a portion of what you own). The company would prefer to get the money you owe them with as little hassle as possible. If you deal with a Consumer Credit Counseling service you will have a better chance of coming off with a discount on what you owe and it will stop the collection agency. If you are paying the company you owe the debt to on a reasonable schedule then they won't need the collection agency. If you agree to pay more than 50% it means that the company will have a better deal then they could get from the collection agency and so their services will no longer be desired. Your CCC should be able to contact the Collection Agency and tell them that you have made a deal with the company you owe and their services are no longer needed.

The Fair Debt Collection Protection Act does not allow a collector to contact you at an hour that is determined to be reasonably inconvenient. That is assumed to be between the hours of 8:00 am till 9:00 pm. After that they are in violation f that act and you can point that out to them. If they don ;t stop you can file a grievance. Google the FDCPA or look it up under wikipedia for more information.

Let me preface this by saying that I work for a collections agency... Let me also say that I am NOT a collector, I work in the IT department (just to clarify).
Calling after 9pm in the debtor's local time zone is a violation. It doesn't forgive your balance but you can report them to be in violation of the FDCPA (THE FAIR DEBT COLLECTION PRACTICES ACT). The FDCPA was created by our government to protect the rights of debtors against harassment from bill collectors. The best you can do is to report this incident and the collections agency can get in trouble. Hope this sheds some light on things.

I would definetly tell them to stop calling and would call the manager to complain.Yes,you still owe the money but no one should be called at that hour by a collection agency.
Do you have a better business bureau? I would notify them of this.

Actually there IS a law that they are not allowed to phone you after 9pm. Im not sure which law it is but if you can prove that they called after this time you can sue the company. I would call the BBB and ask them what the stipulations on this law are.

you can tell a collection agency to stop phoning you, tell them that in the eyes of the law they are falling into the definition of harassment, but that does not mean that you don't owe them the money, it just means they have to stop phoning you,.....

next time they call get the reps name. you can file a complaint.they cannot call after 9:00 and some states allow you to take legal action against them
