Ive lived with my mother in her home for the past 15 years. she is going into a nursing home. how can i protect the house from medicaid estate recovery without effecting her medicaid benefits.

Although, you cannot escape the estate recovery law for anything left in your mother's estate at the time she passes away, you may have another option.

If you lived with her in her home and provided care to prevent her from moving into the nursing home, some states allow the home to be transferred into your name without penalty to her assistance. Check with your worker about this before you do it otherwise she may be ineligible for Medicaid for a time.

i really do not think it is possible....the state is pretty strict, but it is her house and she does need the care.....medicaid will only take what her bills equalled to be.....you could always take care of her.....i know it is hard, i do not recommend it if she has alszheimers, but i am guessing you want the house and you are not going to get it unless you take care of her yourself

my father left my mentally ill sister an annuity benefit . she however never claimed it . she instead continued to collect medicaid and ssi . she died and left the money owed her in the state of Pennsylvania's unclaimed property department . will the money go to her adult children or will the medicare and ssi estate recovery get it . will it be allowed to be used for funeral costs
