My husband owes the state money and which they said they would take his taxs next year. my question is do i have to claim with him in order to get my unearned income credit????

No, you cannot file separately and still claim the EIC. You will want to file jointly with an injured spouse claim. The eic will be prorated between the two of you based on a number of factors and your portion will be refunded to you. I do agree though, that the best thing would be to just get it paid off.

I assume you mean earned income credit, there isn't one for unearned. If you file separately, you can't get the EIC. You can file a joint return and file an injured spouse form, and they'll only take the part of the refund that's due to HIS income and withholding, not yours. If that's not enough to pay what he owes, it would come out of EIC if the two of you get one.

unearned income? what is that? you can get paid for not earning anything? what a country!
