cake or biscuit?

McVitie's have spent years fighting Customs & Excise on this one, because (I think I've got this the right way around), VAT is charged on biscuits, and not on cakes. The VAT-man very conveniently declared Jaffa Cakes as biscuits.

McVitie's (United Biscuits') assertion is that they are cakes, because like cakes they dry out when stale, whereas biscuits go soggy upon staling - a very dull argument about ERH and relative humidity. However, I believe it was worth it, because I think the court has finally ruled in McVitie's favour and they're due a nice little tax refund.

Ooh, you've got me peckish now! Time to put on the kettle and dig out the biccies.

Jaffa is a cake as the base is sponge and not a wheat biscuit hard base

The original Jaffa Cake (many own-brand imitations these days)y is made by McVities. We Brits call it a biscuit - sponge one side and chocolate the other side with a smashing orange bit in the middle. I love them but find them rather expensive, even in Asda. I actually live 5 minutes walk from a McVities factory (Harlesden/Park Royal, NW10) and the smell coming from the factory is delicious. It is the first thing you notice when you get off the train at Harlesden Station.

Cake defo cake, not something I go out and buy on a regular basis but when I do the packet doesn't last long I can tell you hahaha
