so.... I had a tenant living here for the past 5 months... everything was going just fine.. until her sister decided to come on over to where the oil spills and her boyfriend thought he may as well jump on the band wagon as well...
I phoned her.. remember she never makes any "contact" ... told me that she promised that her boyfriend wouldn't stay in the living quarters anymore... duhhh .. it has been 2 weeks already...... and her siters that makes 2 guests 3 weeks...
oh blow me down .. I thought I would call her tonight and ask what was going on.... "oh just to let you know.. I will give one months notice.. we will be all moving out on June 1st.." ... did you need extra money for my sister staying here for the past month? .... well I said... and your boyfriend? was he a ghost in the suite too? .... well I think I should charge 300 per head as a hotel rate...? yeah?

Thanks all for your input and sound advice - it's appreciated!
I did however get a note from the Tenant that to "compensate" for the extra "tenants" in the suite they would be moving out on May 7th.
I have since (thanks to the advice of getting a "landlord kit") issued with a copy of her letter, Notice of Termination on the stated date. (copy for myself as well - just in case !!)

Hindsite is 20/20; but next time make sure it's specified in the lease...also that is part of what deposits are for..it's a guarantee (collateral) that the terms of the lease will be honored or risk losing the deposit. You can pick up preprinted leases at most office supply stores.

Sounds like you may have to take a loss on this one. if they offer exta (cash in hand) take it and cut your losses. A bird in the hand...etc etc

Many cities have a place that you can call to find out what is within the law. Some places help the tenant, some help the landlord. If all else fails, call the tenant's resources place and act like you are a tenant and ask the questions from that POV. That way you get some free advise. It is not legal advice, because they have to say that, but you will know more than you do now when you are finished talking with them. Be careful if you do this in the wrong way, they can sue you.

Never mind those who warn you about evictions. You're not evicting anybody. THEY gave notice to YOU. So go ahead and try to charge extra. It can't hurt and they just might pay up and shut up! Legally, there's not much you can do unless the contract does provide for overnight guests. Some do, most don't.

You are right, you should charge. But since they gave you a notice to move do you think you'll see any money? I really don't think you will, you see there are givers and takers in this world and I do believe you are being taken.

Hmmm.... depends on the lease. If the rent is income based, then she's totally out on her ***, but if the particulars aren't stated in the lease you could get in deep **** if you evict. Legal aide loves eviction cases... watch out.
