Are you saying you illegally obtained a social security number, either by fraud or because you didn't know better to trust some shady character, and then didn't plan to use it (or didn't get the chance to)?
You should know better than that. Only the Social Security Administration can issue vaild SSNs (i.e., ones that you can use legally). Anyway else is a crime, and you don't even have to use it.
And no, you don't get jail time. You get federal prison time for breaking federal laws.

If someone deceived you, then you probably won't do time (they might wonder why you didn't think something was fishy). They can't very well blame you if you didn't know what was going on.
On the other hand, if you haven't used the card for 'anything', you could just destroy it and wait for the real one (or apply for a real one). Here's a link to the application page.

If your name is on a social security card that does not belong to you and you are caught with it, you are in trouble. If you use it to obtain employment or a driver's license, you are in bigger trouble. Fraud and Forgery come to mind.
You don't have to be the one that monkey's with the name, number. You can be accused of possessing a forged social security card.
Run it through the shredder or burn it.

If you have your name linked to someone elses SSN,
Go to SS and straighten it out now .
There could easily be future fraud and your name would be the 1st suspect .
Get yourself cleared now , before criminal offenses happen .
