What laws were made or considered when banning online poker?

Online poker was banned for two reasons.
A. Because Congress is trying to legislate morality.
B. Because the Government doesn't get any profit from it.

Okay, A is the major reason, but there is a lot of B in it as well.

The government taxes "all income earned world wide” and that includes any income made through gambling. If you gamble on the Internet then who knows where the money goes and no matter where it goes the owners of those sites will make sure that not government will be able to tax it and that they will not declare their profits or losses to any government.

The government has tried to administer moral laws before. The worst example was the amendment that prohibited the selling or use of alcohol. People wouldn’t follow the law, in fact they flaunted it and of course prohibition was how the Mafia became rich.

In Texas we used to have “Blue Laws” that prevented merchants from selling some things on Sunday, when people should be in church. The rules are old and arcane, but they hung around for a long time because it was so hard to repeal them. They were a part of the State Constitution and it took a 2/3’s majority in both houses of the state congress to write a new law that would invalidate the Blue Laws. This is an example of an attempt to legislate morality; to pass laws that force people to be moral.

The recent law that put the skids on online gambling state that it is illegal for any American Bank or any Bank doing business in America to accept credit or debt payments made to or from these companies. So online gambling itself is not illegal, you just can’t use your bank to handle the transactions. There are ways to get around this like using money orders or working with a third party. The online gambling companies will find a way to get around the laws; it is only a matter of time. And when that happens a new law will be passed to try and curb it again. Any law made to stop online gambling faces two problems: a person should be able spend their money as they want, and how do you enforce it? The entire idea behind the Internet is to get around any blocks that are made in it.

If you want online gambling then check out the Libertarian Party. Their platform is to give the maximum amount of freedom to the people as possible. Even if that freedom gives them the freedom to mess up their lives.

I think it's ridiculous. I love to play poker and I keep my betting stakes to what I can afford to lose, as do the vast majority of players. Yes, there are people with gambling addictions, no doubt. There are people with addictions to just about everything. If we all have to stop doing something because somebody misuses it, pretty soon, we'll all just be sitting in our houses twiddling our thumbs.

Online poker was never banned.

The law was changed to make it harder for companies to operate an online poker site in America, and financial companies to transfer money to them. But it is no more or less illegal to play online poker now, as it was a year ago.

Here is a good analysis of the law.
