Technically, polygamy has to involve a legally recognized marriage. I say this because you mention "common law marriage." Not all states recognize common law marriages. New York recognizes it while Wyoming does not. Oh, and if the state does "force" a marriage upon people co-habitating by virtue of the common law marriage, then the state will require a divorce to break it... which is why many who co-habitate in those states "break up" for a certain amount of time. This way, the state does not recognize the common law marriage and they stay legally UNmarried.

Some folks can be "married" with the legal license and everything, and not be married in the eyes of God.
On the other hand, there are people who have never had a license whose marriage is holy to them, and I am sure that God will honor their heart's intentions.
Nowhere in the Bible does it say one has to have a license
Having said that, I'd like to add this caveat. To live together without the benefit of the license does say something about your intentions, especially if you have children together, since legal marriage protects the right of the kids to the support of both parents. Of course, the law gaurantees them that right anyway, but children concieved in a marriage are automatically considered to be the children of both Mom AND Dad, unless Dad has ordered and obtained proof that they are not.
Obtaining proof that a child belongs to a specific man could be difficult if the guy chooses to make himself scarce, and the courts are not inclined to push the issue for you.
Many many many women and their kids have learned this sad fact, to their great cost.
While it is true that God knows the intentions of your heart, if your intentions are real, why not get the license?

The answer to question one is NO!!! If it was yes, every man in our universe practically would be a Polygamist.
Question Two...I believe the asnwer would be YES, this is Polygamy because the following definition says "ANY FORM OF MARRIAGE."
The term polygamy (many marriages in late Greek) is used in related ways in social anthropology and sociobiology and sociology. Polygamy can be most succinctly defined as any "form of marriage in which a person [has] more than one spouse."[1]

Polygamy implies a simultaneous relationship. If he were with all four women at once, and all four of them consented to the arrangment, and furthermore considered it a group marriage and had a joint living arrangement, then you've got polygamy. Which is a different thing from bigamy.

Well since monogamy doesn't require one to be married, neither does polygamy. It is just you can't be arrested for having four girlfriends/boyfriends at the one time, whereas you can if you were married to them all.
Polygamy would be having a relationship with all at the same time. Not just four different people at four different times over a 2 year period.

Well I guess, except that it is not legal, so it is Adultery in the United Stated.
But in some countries it is perfectly legal, I have a friend from SUDAN, his mother is #5 so his father doesn't know him at all, but the child does not see the problem, because that idea of multiple wives in common in Sudan, He is Sudo- Christian, a Salvation Army child. He sees no problem with multiple partners, and his own position in life!
