I got a ticket from a police officer last night because he said I came dangerously close to hitting a pedestrian in a crosswalk. However, I didn't see the pedestrian because it was dark outside, and while they could definitely see my Hummer H2, I couldn't see him. Also there are a lot of crosswalks out there, so how do I always know when there's a pedestrian in one? So why wasn't the pedestrian yielding for me? It should also be their fault for not driving.

Also, does anyone know any legal recourse for this ticket, and can I sue the parents of the person I almost hit (I got the person's information, but I don't know if I can sue them because they are only 14, it is the parents, right?)

When we sit our written test for our licence, it says that we must give way to pedestrians that are on a designated walkway/crosswalk.

We are all pedestrians at times, and we'd never get across the road if we had to wait for vehicles to go by.

Hence the rule pedestrians use a designated walkway/crosswalk and we cross safely, because the vehicles yield to us, as it is a designated crosswalk.

Cross the road in a non designated crosswalk then the vehicle has the right of way. And the pedestrian is in the wrong.

This is a simple answer to give. The reason that drivers need to stop for pedestrians is because they have more power and more of the advantage because they are in a vehicle, while the fourteen year old or pedestrian is, when compared, weak. This gives police officers and anybody more than enough reason to be on their side.

We give way to pedestrians because if you hit one you could be up for a murder charge.
But yes you are right too many people just step out in front of cars, and they should be told off by the law.
But you wont be able to anything about your ticket
Just slow down so next time somebody walks out in front of you, you will have time to stop...Just think how you would feel if you did hit and hurt(if not worse) Someone

It was dark outside and you couldn't see him.....did you have your lights on? Do you have a sight impairment that means you shouldn't be driving? Or is your ego just getting in your way? A pedestrian crossing kinda gives you a clue as to who has right of way at that point don't you think. Plus....what is it with everyone wanting to sue someone else!! Why can't people accept responsibility anymore for their actions!?

they were given this right to minimize them being run over by people like you. you sound like one of the thousands of people who haven't a clue as to the rules of the road. the pedestrian had the right of way because they were in the crosswalk. . If I remember correctly, before so many people gave up walking and put so many vehicles on the roadways, drivers had to yield to pedestrians any where they attempted to cross. try to remember walking is a right-- driving is a privilege!!!

the leg was invented before the wheel, so pedestrians have right of way,
as for the pedestrian being able to see you because you were in your hummer h2 & you could not see the pedestrian because it was dark out side next time TURN YOUR LIGHTS ON it might help if not go to spec savers

Would you like pedestrians to bow down at your passing as well? Maybe throw rose petals in your path? What would you do if someone with your attitude ran over your mother or brother, then sued you for being stupid enough to let them walk in their way? Come on, use a little of the common sense God tried to give you, or turn in your driver licence. It appears to be defective.

go ahead and vent. Pay the ticket, and be glad the kids parents don't sue you, then they would have a hummer H-3.

It's a kid, give him a break. Kid and a hummer, who would win in that collision?? The kid wouldn't make a dent in the bumper.

That's the law, like it or not, and the kid was in the walkway.

Go on with your life, there's too much other stuff to worry about than that.

In fact, why not enlist, in Iraq you have the right of way, and you can drive one of their hummers. good luck

Get out of your vehicle and walk off some of the pounds of lard in your brain., then after you as a pedestrian try to cross roads dealing with idiots such as yourself, come back if you can and post your next question

Do you have a brain? If you are not using it, could you donate it to someone who needs one. You are driving a motorized vehicle and they are on foot. I will type real slow for you. You are responsible for their safety. If they should walk into your car the damage would be minimal. You sound like all those other Jane Fonda loving, flag burning, commie wannabe destroyers of all that is good in America. Did you know that America is named after a WOP? Amerigo Vespuci. If we had followed the normal procedure we would all be Vespucilanders. Stop worshipping Osama and come home to yo mama.
