Yes, maybe.

State law appears to say it is acceptable for a minor to posses and consume liquor if in the visible presence of their parents or of-age spouse.
"Sec.106.04
(b) It is an affirmative defense to prosecution under this section that the alcoholic beverage was consumed in the visible presence of the minor's adult parent, guardian, or spouse."

"Sec. 106.05
(b) A minor may possess an alcoholic beverage:
(2) if the minor is in the visible presence of his adult parent, guardian, or spouse, or other adult to whom the minor has been committed by a court"

However in Texas the county has final say in all alcohol laws, meaning this may vary and if you are worried about it, it's best to check with the county court/law office.

If the drinking age is 21 you need to be 21. So no it is not legal

Yes if you are both married, it IS. I bartend and am TABC certified (Texas Alchohol and Beverage Commission). Apparently the posters on here are neither a resident of Texas or know the laws regarding minors.
