i ordered my food(fries, with chilli and cheese on the side) the lady gave me a vibrating alerter for when my order is ready. instead of making that vibrate she then brings my food to me, which is fine but i was pushing her stroller and had 4 other kids around, me we were at a birthday party.! Whill i was juggling the food and dealling with kids the chilli and cheese was spilt on my daughters arm and head.

You cannot count on wait staff to know what's appropriate when dealing with children unfortunately. Nothing upsets me more than when I order my child's food and the waitress or waiter then brings a steaming hot plate of food and places it right in front of my toddler who doesn't know any better than to reach right for it. I have fussed at many a waitress for doing this. Hello? Hot food + kids = a big problem. YOU have to watch for these things and anticipate them happening. YOU have to grab that plate before it's placed in front of your child and YOU have to know that you can't take a tray of hot food while juggling kids. The waitress was negligent in giving you hot food in that situation and not offering to put it somewhere for you, she should not have handed it off like that but you were ultimately the one who spilled it so you could probably sue the establishment but it would depend on a jury who will probably recognize it for the accident that it was unless they were completely convinced of her negligence. Wait staff who don't have children won't think like a parent.

As far as bringing an 8 month old to a birthday party, well children's birthday parties are usually family events and nothing wrong with bringing your baby. YOU just have to be better at anticipating and being prepared for every situation. You are ultimately responsible for your children and any children in your care.

It's not that clear as to who spilt the food. Don't sue if you can't properly explain what happened.
If it was you, then I suggest brushing up on your parenting skills... you should know that kids and hot food don't go too well together.

Don't put the blame on someone else if you caused the damage.

First, you should be slapped for taking a child so young to something like that. Second, you should be slapped for trying to handle that many kids at a place like that. Third, you should be slapped for being careless. And last, you should be slapped for being stupid.

But I don't have that much energy. Sue if you like, you won't get anything but laughed at. It was your fault. Grow up, girl.

Edit to say to the person below me: How is it not her fault? SHE had it, SHE dropped it. If the person would have given her the food and it had been only warm or even cold, she would have complained like a harpy. She ordered it, and knew it was coming, she should have been prepared, and thanked the lady for sparing her from having to go up and get it. Instead she is whining and wanting money for nothing.

Oh, and I did not have any misspellings. If it was me you were referencing, check your dictionary.

No that's what is wrong with people these days. always getting sue happy! It's not her fault you were with a crowd of people and she probably thought she was doing you a favor by bringing the food to you for that very reason. Grow up!

I don't think you CAN sue because you took the food from her, knowing it was hot...rather than asking the waitress to put it on a table. Was the child burned badly? I hope not. If this was a minor burn, there's not much chance of you winning. You can't sue someone because they pissed you off, or because they didn't go out of their way to assist you with 5 kids.

Who are you going to sue? Yourself for scaring the kid for life. Your the one who needed the chilli fries. Your the one that couldn't wait to chow down and dumped her food on the little tike. Quit looking for a big payout for your stupid mistake. Start coming up with a darn good apology for you little girl for scaring her for life. The waitress/counter person was only being nice bring it to you. Your still the one who dumped it.

Looking back now... Did you really need those fries? Or was focusing totally on your kid less important?

IMHO you should have the right to sue

But Some gal threw some hot coffee at her ex BF, slipped and fell on the coffee she spilled, Sued McDonalds and collected

Maybe you can find a dumb Judge

NO, you spilled the food. The thing that sucks that there is a lawyer who would take your case. But you wouldn't want me on the jury. Be more careful next time and don't blame somebody else for your clumsiness.

your the one that tried to do too many things at once. you should have seated the kids first then worried about the food. sorry to hear about your daughters head though
