If he was married in his country before he immigrated to the US and never legally divorced his wife who is still back in his home country, what must he do to get legally married now in the US?

HE IS NOT LOOKING FOR A GREEN CARD.....he is already an American citizen. He just did not divorce his wife because they have a child which he takes care of, their relationship ended long ago. Now he is ready to remarry and I was asking the legal way for us to handle this.

Which is his home country? If it happens to be India he cannot marry second time till his first marriage exist otherwise his first wife can file criminal complaint against him for the offence of bigamy back here in India for which he will be deported back to India & face the trial.For you to marry him he should first get dercee of divorce back from here, such a decree is legal & valid in any country of the world. Honey, he dont love you, let me tell you, he wants a GREEN CARD!!! and you will live your life in your own personal hell if you marry this loser. He will bring his family here once he is married with the green card!!! do your civic duty and call INS on him. If you marry him, you can go to jail! he is married! he will have to go through a divorce, and more than likely he will have to go back to his country to do it, or pay very high legal bills here for an attorney to take care of it. Find someone else! this one is just too much trouble and will cost you a fortune in the end.

He needs to get a divorce.No if's and's or but's.
Why would you even consider marrying a man who left his wife behind in another country? That would put up big warning flags to me.
If he doesn't want to go ahead and get a divorce,maybe it's because his wife thinks she will be coming to the U.S. one day to be with him.
I would give this a great deal of thought if I were you and marriage to him would be the LAST thing on my mind.Hope you make the right decision.

You need to speak to the INS first, you should read their list of FAQ's. You can't just marry someone and then they are an American. He will have to legally imigrate to the United States. It is a fairly length process.
He needs to file the application from his home country. Hopefully the local law enforcement over there won't catch up with him while he is lurking around the old neighborhoods.
It isn't that easy to do, you may want to think about a domestic unit instead of one of those foreign imports. They can be awfully finicky and difficult to service.
PS. What language do your future step kids speak?

Get a divorce in his own country first.
What would happen if his first wife came to America???
And why hasn't he done this already. I would be suspcious.
He should contact his embassy and find out how to do it.
You should not even be doing ANY of the research on this. If he's not getting this taken care of himself, then I would reconsider getting involved with him. It says that you're not all that important to him.
I would also be worried that he might have other "wives" in other countries too!
Proceed with caution!

If his country of origin does not recognized divorced, US respect also this law and therefore he cant legally marry you in the US.
