I think the charge is felony child support, he owes my children 32000 dollars in arrears. I can't find out for sure if that is the charge that they are holding him for. He also has a felony charge in another county for embezzelment. He was arrested in Florida on April 7 and has been there for 2 weeks now. I just want to know if he will be extradited and when. Even if the charge is not for the child-support I may be able to at least see him in court if he is brought back to Virginia.

If your ex-husband was arrested as a fugitive, then he will be extradited back to the state (and county) where the warrant was issued from. Your ex can waive extradition which means that he will agree to go back to the issuing state OR he can make the issuing state (Virginia) file the extradition paperwork which means that a petition has to be sent to the governor of VA and then to the governor of FL for processing. If your husband waives extradition, then VA can go pick him up at their convenience. If your husband does not waive extradition, then it could be up to 90 days. You should try calling the court in Virginia to see what the warrant is for (the court covering the area where your divorce was granted thru and/or the court covering the area where the embezzlement occurred). Criminal charges are, for the most part, a matter of public record. You could also call the child support enforcement office to see if they issued a warrant for your ex and advise that he was arrested in FL and they could check to see if their warrant was served.

Florida didn't used to send people back for domestic issues, but they may have changed their laws and agree to cooperate in prosecuting him there. I am not sure they will extradite him, though. Your best bet is to hire a lawyer in Virginia and ask him/her to make a call to the authorities in Florida to find out for you. This could be done in an hour or so, so shouldn't cost all that much. It might be well worth it.

Yep, they'll haul him back to Virginia...it could take a few weeks though.

he WILL be extridited, thats up to the court
this will take a while
and he is likely to do Lengthy sentences in Prison
