my mom put a securty deposit and first months rent down on a house but she still needed last months but the lady said it was ours evev though she told my mom that she was holding another deposit so my mom took my grandparents to see it and the ladys boyfriend was their with the music full blast then when my grandpa got his attention he asked if they could see it he sais yes then later the lady calld my mom and yelled at her saying she has no right to go over without an appt so my mom didn't feel mconfortable with the place no more and asked for her money back can she do that

okay when my mom asked about an applacation the lady gave her a job applaction to fill out and now her for rent sign is gone

all this happened in a matter of 4 days monday she got the deposit thursday she she got evil thursday night my mom asked for her money back friday the lady said mabey not

I don't think you have a case. There's nothing preventing you from moving in except personal preference, and there's nothing stopping you from getting a restraining order against the landlord.

It depends on how much time passed between she giving the deposit and she backing up.

The purpose of paying the deposit before moving is to make sure no one else get the house so now the landlord can claim that she couldn't sell the house to someone else because she was saving the house for your mother.

So your mother can say goodbye to that deposit if she back-off now, she can try to ask for it just in case, but is almost sure the landlord wont give it back.

You didn't say she had signed anything. If she hasn't signed anything, then probably she can get the money back, BUT:

a) don't expect them to be happy about it and give it up without a fight, and

b) there may be state laws that control this situation.

I'd say ask for the refund formally, which means in a certified letter, see what happens, and if you don't like it, talk to a lawyer.
