If a person is caught with it in Massachusetts, will they be put in prison or have to pay a fine?

My boyfriend is using and I am afraid for him. I would never use drugs after what they put my family through. What you said was incredibly rude and ignorant.

It all depends on the circumstances. If he is caught with a small amount (usually under 20 grams) that is obviously for personal use, and he is not a habitual offender, it is most-likely he will be placed on some form of probation usually involving random drug tests, community service and possibly a fine.

The punishment is more severe if he's caught selling, or with a large amount that can be interpreted as tryiing to sell, however for a first offense it will probably be a more restricted form of probabtion. Luckily society is taking a more educated stance on marijuana punishment. Because of this it's rare for a marijuana user to see jail on a first offense as long as it doesn't involve cultivation.

Massachussetts is experimenting with some new punishments for this. For first offense, the person has to listen to eight straight hours of Teddy Kennedy's speeches from the Senate Floor.

It shows real promise, and may be implemented for more serious infractions.
